The Situation

My client was facing fifteen counts of Rape of a Child in Dickson County Circuit Criminal Court — a sentencing exposure of 325 to 900 years in prison. As staggering as those numbers were, the state had one more card it intended to play: my client had a prior conviction for a sex offense, and prosecutors planned to introduce that conviction in front of the jury.

In a case already stacked against a defendant, that kind of evidence is devastating. Jurors are human. Once they hear that someone has already been convicted of a sex crime, the presumption of innocence effectively evaporates. The state believed that prior conviction would be the finishing blow. We disagreed — and we filed a motion to keep it out.

Tennessee Rule of Evidence 404(b)

Rule 404(b) governs the admissibility of prior bad acts in criminal proceedings. The rule reflects a foundational principle of American justice: a person is tried for what they are accused of doing, not for who they are or what they've done before.

To admit prior bad act evidence, the state must show it's relevant to a specific material issue — intent, identity, absence of mistake, motive — and that its probative value outweighs unfair prejudice. That last requirement was where we focused our argument.

The Hearing

We requested a hearing outside the presence of the jury and prepared extensively for it. Our argument was straightforward: the state wasn't introducing this prior conviction to prove anything specific about this case. They were introducing it to poison the jury — to make jurors afraid of my client before hearing a single piece of evidence about the charged offenses. That is precisely what Rule 404(b) is designed to prevent.

We also attacked the state's characterization of the "material issue" they claimed justified admission. The prior conviction involved different conduct, different circumstances, and a different alleged victim. It didn't establish identity. It didn't establish intent in any meaningful way not already inferable from the charges themselves. The only real purpose it served was to tell the jury: this man has done something like this before.

"Once a jury hears a prior sex crimes conviction, you've lost the presumption of innocence. The rest of the trial becomes a formality. That's not justice — that's character assassination dressed up as evidence."

The Ruling & What Happened Next

The judge ruled in our favor. The prior conviction was excluded. The state could no longer walk into that courtroom and introduce my client's history to the jury — they had to try the case they charged, based on the evidence they had for these fifteen counts, without the prior conviction to do their heavy lifting.

Following the ruling, the calculus changed entirely. Plea negotiations reopened. We negotiated a resolution in which my client received credit for his year already served in jail and was released that same day on three years of probation.
